Draft for review — not in force

This page is an unpublished draft of the Regton Affiliate Programme Agreement, prepared 7 September 2026. It is not linked from anywhere on the site and is not currently binding on anyone. Six points marked [FOR REVIEW] below still need a decision — they are listed together at the end of the page.

Regton Affiliate Programme Agreement

Regton Ltd
Registered in England and Wales, company number 01595972
Registered office: 82 Cliveland Street, Birmingham B19 3SN
VAT registration GB377390224
Version 1.0 (draft)

1. Who this agreement is between

This agreement is between Regton Ltd, a company registered in England and Wales under company number 01595972, whose registered office is at 82 Cliveland Street, Birmingham B19 3SN (“Regton”, “we”, “us”), and the person or business accepted into the Regton Affiliate Programme (“you”, “the affiliate”).

By submitting an application you confirm that you have read this agreement and accept it. It takes effect when we approve your application and continues until either of us ends it under clause 10.

You must be at least 18 years old. If you are applying on behalf of a business, you confirm that you are authorised to accept this agreement for it.

2. Joining the programme

Applications are reviewed by a person. They are not approved automatically. We may decline an application, or later withdraw approval, at our discretion — for example where an applicant’s website or channel is not a good fit for our products or audience.

We will normally decline or withdraw where a site or channel:

  • contains sexually explicit, violent, hateful or otherwise unlawful material;
  • discriminates on the basis of any protected characteristic;
  • infringes anyone’s copyright, trade marks or other rights;
  • uses “Regton” or a close variant in its own domain name, or is presented so as to suggest that we operate it;
  • encourages detecting without the landowner’s permission, detecting on scheduled monuments or other protected land, or any other breach of the Treasure Act 1996 or its Code of Practice;
  • distributes software, toolbars or browser extensions capable of overwriting affiliate tracking.

The fifth point is specific to our trade and we take it seriously. Promotion that encourages irresponsible detecting will end an affiliate’s participation.

3. How referrals are tracked

On approval you receive a unique affiliate link carrying an acc parameter. When someone follows it, we store cookies in their browser that record you as the referrer.

Those cookies last 365 days. If the visitor buys from regton.com within that period the order is attributed to you — unless they had already arrived through another affiliate’s link, because the first affiliate to refer a visitor keeps the attribution for as long as the cookie lasts.

Referrals are tracked on regton.com only. Purchases made on our other websites, over the phone, in the shop, or through a marketplace such as eBay or Amazon do not earn commission.

Tracking depends on the visitor’s browser accepting the cookies and on the cookie choices they make. We cannot pay commission on a referral our system did not record.

4. What you earn

Affiliates sit in a commission group. New affiliates join the Standard group. We may move an affiliate to the Partner group at our discretion, which we would normally do on the strength of sustained referral volume.

  • Standard — 5% on a new customer’s order, 3% on the order of a customer who has bought from us before.
  • Partner — 10% on a new customer’s order, 5% on the order of a customer who has bought from us before.

What counts as a new customer. The higher rate applies only where the customer has never previously placed an order with Regton under that email address. It is not “the first order you refer”. A customer who has bought from us before — even years ago, and whether or not an affiliate was involved — is charged at the lower rate from the outset.

What commission is calculated on. Commission is a percentage of the value of the qualifying items in the order, after any discount and including VAT. Delivery charges are excluded and earn no commission.

Commission is credited when an order reaches Complete. It is then held for 30 days before it can be withdrawn, so that returns can run their course.

If a referred order is refunded, cancelled or closed, in whole or in part, the corresponding commission is reversed — including after it has been credited. A reversal can put a balance into deficit, in which case it is offset against later commission.

We may change commission rates, and any other term of this agreement, at any time and with immediate effect. We will tell you by email when we do. Changes apply to referrals made after the change; commission already credited is not affected.

5. Getting paid

You can request a withdrawal once your available balance reaches £50.00. Payment is made by PayPal or bank transfer, to details that you supply and keep current. Payments are made in pounds sterling.

[FOR REVIEW] We aim to pay approved withdrawal requests within … working days of approval.

[FOR REVIEW] You are responsible for your own tax. Commission is paid gross. If you are VAT-registered, … (do affiliates invoice Regton, or does Regton self-bill?)

Where we reasonably suspect that referrals are not genuine, we may withhold payment while we investigate, and decline it if the suspicion is borne out.

6. Referrals that do not count

No commission is earned on:

  • your own purchases, or those of your household, business or staff;
  • orders that are cancelled, refunded, unpaid or fraudulent;
  • orders placed with a discount code obtained in breach of clause 7;
  • referrals generated by automated traffic, incentivised clicks, or anything else that fakes a genuine visit;
  • delivery charges;
  • orders on any Regton website other than regton.com.

7. How you may promote us

You may promote Regton on websites, social channels, videos and email lists that you own or control, using the links and any banners we supply.

You must not:

  • bid on “Regton” or close variants in paid search, or use them in advertisement display URLs;
  • send unsolicited email, or post to forums and groups that do not welcome commercial posts;
  • present yourself as Regton, or imply that we endorse content we have not seen;
  • state prices, stock levels or delivery terms as fact — link to the site instead, because those change;
  • post your affiliate link to voucher, cashback or coupon sites without our written agreement;
  • run paid advertising that sends traffic straight to regton.com without passing through a site of your own first.

You must make clear that your links are affiliate links, in the manner the ASA/CAP Code requires. That obligation is yours as the publisher and we cannot discharge it for you.

8. Our brand

While you are an affiliate in good standing we grant you a non-exclusive, revocable, non-transferable right to use the Regton name and the logos and banners we supply, solely to promote us under this agreement. You may not alter them. All goodwill in them belongs to us. The right ends when this agreement ends.

9. Data protection

Each of us acts as an independent controller for the personal data we hold. We process your application and payment details to run the programme and to meet our legal obligations; our Privacy Policy explains how, and our Cookie Policy covers the referral cookies described in clause 3.

We do not give you personal data about referred customers. Your reporting shows order values and dates only.

If you collect personal data through your own promotion, that is yours to handle lawfully, including your own cookie and consent notices.

10. Ending the agreement

Either of us may end this agreement at any time by written notice, including by email. We may suspend or end it immediately, and withhold unpaid commission, where you have breached it materially — in particular clauses 2, 6 or 7.

On termination you must stop using our brand and remove your affiliate links. Commission already credited and past its holding period remains payable, provided the referrals were genuine and your balance is at or above the £50 threshold.

[FOR REVIEW] Where the balance is below £50 on termination, … (is it paid anyway, or does it lapse?)

11. Liability

Nothing in this agreement limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

[FOR REVIEW] Subject to that, we are not liable for indirect or consequential loss, or for loss of profit, revenue, goodwill or anticipated savings, and our total liability under this agreement is limited to the commission paid or payable to you in the … months before the claim.

We do not guarantee that the site or the referral tracking will be available without interruption or error.

12. General

You are an independent contractor. Nothing here creates employment, partnership, agency or a joint venture, and you may not make commitments on our behalf.

You may not transfer this agreement. We may transfer it to a company acquiring our business.

This agreement is the whole agreement between us on this subject. If any part of it is unenforceable, the rest continues in force.

[FOR REVIEW] This agreement is governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. (Stated as the natural default for an England-registered company — please confirm.)

Points still needing a decision

These are the only outstanding items. Everything else in this draft has been settled or verified against how the programme is actually configured.

  1. Clause 5 — payment turnaround. How long after approving a withdrawal request should we say we will pay? A stated figure is better than silence.
  2. Clause 5 — VAT. Where an affiliate is VAT-registered, do they invoice Regton, or does Regton operate self-billing? This determines who issues the VAT document.
  3. Clause 10 — balances under £50 on termination. Paid anyway, or forfeited? Whichever we choose should be said plainly; silence tends to be read against the drafter.
  4. Clause 11 — liability cap period. Twelve months is the usual figure. Confirm or change.
  5. Clause 12 — governing law. England and Wales assumed. Confirm.
  6. Overall. Anything a legal reviewer wants added — the draft is deliberately short and plain rather than exhaustive.

For reference, the commercial terms above are not proposals: they are what the system is actually configured to do today. Changing any of them means changing the configuration as well as this text.
